DELHI — Delaware County District Attorney Shawn J. Smith announced today that the Delaware County Grand Jury returned an eight-count indictment against Sidney F. Wallace, 69, of Roxbury, New York on February 20, 2025.
Count One alleges Course of Sexual Conduct Against a Child in the First Degree, a Class B Felony. It is alleged that Sidney Wallace, between 2023 and 2024, engaged in sexual acts with a child less than thirteen years of age.
Count Two alleges Sexual Abuse in the First Degree, a Class D Felony. It is alleged that Sidney Wallace, between 2023 and 2024 subjected another person to sexual contact and that individual was less than thirteen years old.
Count Three alleges Sexual Abuse in the First Degree, a Class D Felony. It is alleged that Sidney Wallace, between 2023 and 2024 subjected another person to sexual contact and that individual was less than thirteen years old.
Count Four alleges Sexual Abuse in the First Degree, a Class D Felony. It is alleged that Sidney Wallace, on or about July 28, 2024, subjected another person to sexual contact, and that individual was less than thirteen years old.
Count Five alleges Sexual Abuse in the Second Degree, a Class A Misdemeanor. It is alleged that Sidney Wallace, on or about the Spring of 2023 did subject a separate victim to sexual contact and that victim was also less than fourteen years old.
Count Six alleges Sexual Abuse in the Second Degree, a Class A Misdemeanor. It is alleged that Sidney Wallace, in or about July of 2023 did subject another person to sexual contact and that victim was less than fourteen years old.
Count Seven & Eight alleges Endangering the Welfare of a Child, a Class A Misdemeanor. It is alleged that Sidney Wallace knowingly acted in a manner likely to be injurious to the physical, mental, or moral welfare of two children less than 17 years old.
As with all cases involving minors, the identity of the victims are being withheld per office policy.
District Attorney Shawn Smith commended Investigator Adam Cernauskas of the New York State Police for his thorough investigation into this serious case. DA Smith also thanked the tireless advocates at Safe Against Violence for making sure the victims were and are supported as the case progresses.
Assistant District Attorney Denise J. Kerrigan presented the case to the Grand Jury.
Indictments and Criminal Complaints are allegations. All defendants are presumed innocent unless proven guilty.
