Sentence in Vehicular Assault Case

 DELHI - Andras Kasuba, 50, of Brooklyn, New York appeared before the Delaware County Court on February 4, 2025, and was sentenced to time served to be followed by five years’ probation supervision for the crimes of Aggravated Vehicular Assault, a Class C Felony, and Driving While Intoxicated, First Offense, an Unclassified Misdemeanor. 

On March 18, 2023, Deputy Lucas Elmore of the Delaware County Sheriff’s Office responded to a motor vehicle crash on Highway 26 just north of Gregory Hollow Rd.  Deputy Elmore identified Andras Kasuba as the driver of one of the vehicles. Three individuals needed extraction by helicopter due to serious physical injuries sustained in the accident. Deputy Elmore determined that Kasuba was intoxicated at the time of the collision and had caused the crash.  Kasuba had a blood alcohol content of 2.5 times the legal limit.

Kasuba was arraigned on May 2, 2023, by the Town of Colchester. After his appearance, Kasuba fled Delaware County. Kasuba was also the subject of a deportation proceeding in which he also failed to appear. With the assistance of the New York City Police Department, Kasuba was eventually apprehended in Brooklyn, New York, and arraigned in the Delaware County Court on June 16, 2024.

As part of a negotiated plea agreement, the defendant admitted to driving intoxicated on March 18, 2023, and injuring three individuals due to his actions. Kasuba appeared in court on February 4, 2025, for sentencing. First Assistant District Attorney Schuyler Konior Kinneman requested the imposition of the agreed-upon sentence noting, however, that Immigration and Customs Enforcement (ICE) had placed a detainer warrant on Mr. Kasuba. 

First ADA Konior Kinneman read from the victim impact statements collected noting that at least one of the victims, who feels intense anxiety whenever she gets in a car, and that all three of the victims had injuries that resulted in medical evacuations to Albany. ADA Konior Kinneman remarked that the situation was a tragedy and that he hoped Mr. Kasuba would use probation to get sober, and that if he was deported to Hungary, that he seeks immediate care for his addiction there.

Judge John L. Hubbard sentenced Kasuba to time served (about eight months) and five years of felony probation supervision. Judge Hubbard agreed with the People that the case was truly a tragedy for all involved and that he hoped Mr. Kasuba would get treatment. 

District Attorney Shawn Smith commended Deputy Lucas Elmore of the Delaware County Sheriff’s Office for his thorough investigation into this case. “I want to thank Deputy Lucas Elmore for his fine work in bringing criminal charges against Andras Kasuba. I want to further thank the officers of the NYPD for assisting us in apprehending Mr. Kasuba when he decided to flee.”

DA Smith continued, “Our office remains dedicated to tracking down every defendant who thinks he can wait out charges. As Mr. Kasuba found out, charges don’t go away when you run from them.”

First Assistant District Attorney Schuyler Konior Kinneman prosecuted the case.
