DELHI — Delaware County District Attorney Shawn J. Smith announced that John Macrabie, 27, of Bainbridge, was sentenced to six years of sex offender probation and classified as a Level Two Sex Offender.
The defendant appeared in Delaware County Court on August 26, 2024, for sentencing. Previously, Mr. Macrabie had pled guilty to Sexual Misconduct- Oral Sexual Conduct, a Class A Misdemeanor. Mr. Macrabie engaged in oral sexual conduct with a 15-year-old child in the Town of Walton on September 4, 2021.
During sentencing, Judge Gary Rosa heard arguments from 1st Assistant District Attorney Schuyler Konior Kinneman that Mr. Macrabie should be judged a level two sex-offender which would require him to be a lifelong registrant on the Sex Offender Registry. As a basis for doing so, Mr. Konior Kinneman argued that Mr. Macrabie was likely to re-offend. Further, Mr. Macrabie had expressed no remorse for his actions and attempted to blame the victim several times.
The defense argued that Mr. Macrabie had privately expressed remorse, and that a level one sex-offender designation would be more appropriate. Judge Rosa disagreed, finding Mr. Macrabie had not expressed remorse. The Court then designated Mr. Macrabie a Level Two Sex Offender and sentenced him to six years of sex offender probation supervision.
District Attorney Shawn Smith commended Delaware County Sheriff’s Deputy Justin Mohr for his thorough investigation into this case. Smith also thanked the victim’s advocates at Safe Against Violence for the support they provided to the victim in this case.
