CONVICTION IN DOMESTIC ASSAULT CASE

DELHI – District Attorney Shawn J. Smith announced today that Hayes A. Cutting, 45, of Bainbridge New York pled guilty to One Count of Aggravated Family Offense, a Class E Felony in Delaware County Court on April 15, 2024.  

Cutting appeared in Delaware County Court on April 15, 2024, and pleaded guilty to the Class E Felony of Aggravated Family Offense. Prior to pleading guilty, the defendant admitted that on January 28, 2023, while in the Village of Sidney, he intentionally choked an 18-year-old female.  Sidney Police Officer Morgan Smith responded to the incident and determined that the defendant was in a relationship with the victim’s mother and committed the acts while visiting the 18 year old’s mom at her home in Sidney.  

The guilty plea was entered pursuant to a negotiated disposition wherein it is agreed that the defendant will be sentenced to an indeterminate term of state prison for 1.5 to 3 years.  The defendant is currently serving a 5-year state prison sentence for unrelated assault charges, and it is anticipated that these sentences will run concurrently. 

District Attorney Smith commended Sidney Police Officer Morgan Smith for her thorough investigation of this case, which enabled us to secure a conviction without the need for a trial. 

As are all defendants, this defendant is presumed innocent until proven guilty in a court of law.
