DELHI – District Attorney Shawn J. Smith, announced that Eva M. Witteman, 60, of Binghamton, New York, was resentenced to 1.5 years in state prison and 1 year of post- release supervision after admitting to a violation of probation in Delaware County Court on April 15, 2024.  Witteman was sentenced to probation on April 8, 2024, for her conviction of Criminal Possession of a Controlled Substance in the Fifth Degree, a Class D Felony.

Three days after being sentenced to felony probation supervision, Witteman tested positive for drugs. Witteman also arrived at the Delaware County Probation Department wearing a false bladder containing a third party’s urine in an attempt to mask her drug testing results. Due to her multiple violations, Witteman has been resentenced to one and a half years in prison and one year of post release supervision.

District Attorney Smith commends the Delaware County Probation Department on their thorough investigation of this case.  Smith stated, “The Delaware County Probation Department provides defendants with every resource necessary for probationers to turn their lives around and become successful members of our community. But when a defendant is unwilling to comply with their supervision, incarceration is the only other option available.”
