CONVICTION IN CHILD SEXUAL ABUSE CASE

DELHI — Delaware County District Attorney Shawn J. Smith announced that John Macrabie, 27, of Otego, New York pleaded guilty to Sexual Misconduct, a Class A Misdemeanor on June 3, 2024. 

The defendant appeared in Delaware County Court on June 3, 2024, for the continuation of a Huntley hearing.  However, instead of proceeding with the hearing, the defendant pleaded guilty to Sexual Misconduct- Oral Sexual Conduct, a Class A Misdemeanor.  The defendant is alleged to have engaged in oral sexual conduct with a 15-year-old child in the Town of Walton on September 4, 2021. 

This guilty plea was entered pursuant to a negotiated disposition wherein it is expected that the defendant will be required to register as a sex offender for at least 20 years, and he will also be placed on sex offender probation for 6 years.  

The case is scheduled for sentencing on July 22, 2024, at 10:00 A.M. 

District Attorney Smith commended Delaware County Sheriff’s Deputy Justin Mohr and the Criminal Investigation Division of the Delaware County Sheriff’s Office for their thorough investigation into this case. Smith also thanked the victim’s advocates at Safe Against Violence for the support they provided to the victim in this case.  

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
