Delhi Resident Arrested on Warrant

Delhi – Today, Sheriff Craig DuMond announced the arrest of a Delhi, New York resident after a warrant was issued for his arrest by the Town of Walton Court, and the Town of Deposit Court.

On Wednesday May 7th, 2024, Sheriff’s Deputies responded to a domestic that was no longer in progress in the Town of Walton. During the course of their investigation, Sheriff’s Deputies found that on May 1st, 2024, while in the Town of Walton Michael Kirby, age 62 had violated an order of protection that was in place by the Town of Delhi Court. Further investigation by Sheriff’s Deputies found that Kirby had recklessly engaged in conduct which created a substantial risk of serious physical injury to another person. It was further found that on May 3rd, 2024, while in the Town of Deposit Michael Kirby had violated the order of protection that was in place by the Town of Delhi Court and that Kirby had sent text messages to the victim threatening to cause physical harm. At the end of their investigation Sheriff’s Deputies sent a warrant request to the Town of Walton Court and to the Town of Deposit Court.

On Wednesday May 22nd, 2024, Sheriff’s Deputies responded to a domestic no longer in progress in the Town of Delhi. During the course of their investigation Sheriff’s Deputies found that Michael Kirby had violated the order of protection out of the Town of Delhi Court by means that Kirby had subjected the victim to physical contact.

On Wednesday, May 29th, 2024, Sheriff’s Deputies located and arrested Michael Kirby on an arrest warrant out of the Town of Walton for Criminal Contempt 1st a Class E Felony, and Reckless endangerment 2nd a Class A misdemeanor. Sheriff’s Deputies also arrested Kirby on the arrest warrant out of the Town of Deposit Courts for Criminal Contempt 1st a Class E Felony, and Aggravated Harassment 2nd a Class A misdemeanor. Kirby was charged with a third count of Criminal Contempt, 1st a Class E Felony and Harassment 2nd a Violation from the incident from May 29th, 2024.

Kirby was transported to Delaware County Centralized Arraignment Court where he was remanded to the Delaware County Correctional Facility in lieu of $10,000 cash bail or $50,000 secured bond.
