DELHI – District Attorney Shawn Smith announced today that Nikita M. Kingsbury, 38, of Sidney, New York, appeared in Delaware County Court on September 23, 2024, and was sentenced to a two-year period of incarceration to be followed by two years of post-release supervision.
This sentence was an agreed upon disposition of a plea agreement where Ms. Kingsbury previously pled guilty to two counts of Criminal Possession of a Controlled Substance in the Fifth Degree with the Intent to Sell, a Class D Felony in violation of Section 220.06 (1) of the Penal Law of the State of New York on July 22, 2024.
On July 13, 2023, the defendant was indicted by the Delaware County Grand Jury on allegations that she sold methamphetamine in the Village of Sidney on August 11, 2022. Shortly afterwards, the defendant was arrested and then released on her own recognizance while the case was pending. Separately, a felony complaint was filed against Ms. Kingsbury alleging the sale of illegal narcotics in the Town of Davenport on May 21, 2024.
On September 23, 2024, the defendant appeared in Delaware County Court before the Honorable Judge Gary Rosa. First Assistant District Attorney Schuyler Konior Kinneman requested the imposition of the agreed upon sentence and implored Ms. Kingsbury to take part in any treatment programs available to her while incarcerated. Judge Rosa also stressed to Ms. Kingsbury that any addiction problems she might have, were separate from this plea and were not going away.
District Attorney Shawn Smith commended the work of the New York State Police and the Delaware County Sheriff’s Office in this case. “Thanks to Investigator Robert Quick of the NYSP and Investigators Chris Erwin and Todd Haven of the Delaware County Sheriff’s Office, another drug dealer is going to prison.”
