15 COUNT INDICTMENT

$15,000 of Fentanyl, Crack, Cocaine, and Methamphetamine Seized 

DELHI - Delaware County Acting District Attorney Shawn J. Smith announced that Misty L. Cintron, 43, and Brandon J. Hendricks, 50, both of Sidney, New York were indicted for 15 charges by the Delaware County Grand Jury on November 9, 2023. 

Counts One and Two of the Indictment charge the defendants with the Class D Felony of Criminal Possession of a Controlled Substance in the Fifth Degree, and allege that the defendants possessed cathinone, a stimulant, with intent to sell it.  

Counts Three, Four, Five, Six, Seven, and Eight each charge the defendants with the Class B Felony of Criminal Possession of a Controlled Substance in the Third Degree.  Those Counts allege that the defendants each possessed quantities of different controlled substances, including fentanyl, crack, and cocaine, with the intent to sell them.

Counts Nine and Ten charge the defendants with additional Class B felonies and allege that they each possessed over 1/8 ounce of methamphetamine with the intent to sell it. 

Count Twelve of the indictment accuses Misty Cintron of Tampering with Physical Evidence, a Class E Felony. Count Thirteen accuses Brandon Hendricks of Criminal Possession of a Weapon for allegedly possessing a 12-gauge shotgun while being prohibited from doing so.

Counts Fourteen and Fifteen accuse the defendants of Criminally Using Drug Paraphernalia and allege that they possessed packaging material, cutting agents and scales that were being used for the sale and distribution of illegal narcotics.  

Charges arose from a search warrant executed by the Delaware County Sheriff’s Department in the Village of Sidney on November 1, 2023.

Acting District Attorney Shawn Smith commended the Delaware County Sheriff’s Department for their thorough investigation into this case, which resulted in this indictment and the seizure of approximately $15,000.00 in dangerous narcotics.  Acting D.A. Smith stated, “My office will continue to partner with the Delaware County Sheriff's Office to ensure that illegal drugs are removed from our communities.” 

Sheriff DuMond remarked, “Let these indictments be a signal to individuals who are currently selling drugs in Delaware County…we will find you, arrest you and prosecute you to the fullest extent of the law.  I am extremely proud of our team at the Sheriff’s Office as well as the close partnership that we have with our District Attorney and local law enforcement agencies.  I want to thank the Sidney Police Department for their assistance with this case and also District Attorney Shawn Smith for bringing these much-deserved indictments.”

Indictments and criminal complaints are allegations, all persons accused of a crime are presumed innocent until proven guilty in a court of law.
