CRIMINAL CONTEMPT CONVICTION

DELHI  – Acting District Attorney Shawn Smith announced today that Dakota Mann, 22, of Walton, New York, appeared in Delaware County Court on November 13, 2023, and pleaded guilty to Criminal Contempt in the First Degree, a Class E Felony.

Mann appeared before the Honorable Gary A. Rosa, Acting Delaware County Court Judge, on Monday November 13th and pleaded guilty to Criminal Contempt in the First Degree, the top charge of the Superior Court Information.  

Prior to pleading guilty, the defendant admitted that he was aware of an order of protection prohibiting him from having contact with the protected party.  Despite being aware of that court order, the defendant had contact with the victim and “engaged in a domestic dispute.” 

This guilty plea was entered as part of a negotiated disposition whereby it is agreed that the defendant will be sentenced to 1 year in the Delaware County Correction Facility.  Sentencing is scheduled for November 27, at 9:00 A.M. 

Acting District Attorney Shawn Smith thanked Trooper Gabriel Miller and Investigator Adam Cernauskas of the New York State Police for their investigation into this case. Smith stated, “My office will continue to work with law enforcement to ensure that individuals are held accountable when they violate an order of protection.”
