DELHI - Delaware County District Attorney Shawn J. Smith announced the indictment of Frank A. Mazepa, 28, of Morris, New York. The Delaware County Grand Jury indicted Mazepa on January 25, 2024, for one Count of Criminal Possession of a Controlled Substance in the 5th Degree, a Class D felony.
The defendant appeared in Delaware County Court on February 6, 2024, and was arraigned on the indictment. The indictment alleges that the defendant knowingly and unlawfully possessed fentanyl or methamphetamine with the intention of selling it in the Village of Delhi on January 8, 2024.
The defendant pleaded not guilty to the charge, and Delaware County Court Judge John L. Hubbard remanded the defendant to the Delaware County Correctional Facility in lieu of $5,000.00 cash bail or $50,000.00 bond. The case is scheduled for a court conference on February 20, 2024, at 1:00 p.m.
District Attorney Shawn Smith commended Delaware County Sheriff’s Deputy Justin Mohr along with his K-9 partner Dexter and SUNY Police Officer David Vorisek for their investigation of this case.
Chief Assistant Richard D. Northrup Jr. presented the case to the Grand Jury.
As are all persons accused of a crime, the defendant is presumed innocent unless proven guilty in a court of law.
