GUILTY PLEA AND SENTENCE IN DRUNK DRIVING CASE

A picture containing person, wall, indoor, person

Description automatically generated

DELHI – Autumn Transue, 30, of Oneonta, New York, appeared in Delaware County Court on January 31, 2024, before the Honorable Judge John L. Hubbard, and pleaded guilty to one count of Driving While Intoxicated – Prior Conviction in Ten Years, a Class E Felony in violation of section 1192 (3) of the Vehicle and Traffic Law of the State of New York.

On March 8, 2023, Officer Ernest Cawley of the Colchester Police Department observed a gray Chevrolet crossing the double yellow lines on County Highway 7 multiple times. After initiating a traffic stop, Officer Cawley identified the driver as Autumn Transue and observed signs of intoxication. Ms. Transue admitted to having consumed “99 Banana Liquor” and being intoxicated. Officer Keith Gavette of the Colchester Police Department would later perform a breathalyzer test on Ms. Transue revealing her blood alcohol content (BAC) to be .12%. The legal limit in the State of New York is .08 percent.

It was later determined by the District Attorney’s Office that Ms. Transue had an out of state conviction for Driving While Intoxicated.  After securing her Nevada records, the Delaware County District Attorney’s Office presented Ms. Transue’s case to the Delaware County Grand Jury. On July 13, 2023, a two-count indictment was returned accusing the Defendant of Driving While Intoxicated – Prior Conviction in Ten Years, a Class E Felony in violation of section 1192(3) of the Vehicle and Traffic Law of the State of New York and Driving While Intoxicated, a Class E Felony in violation of Sections 1192 (2) /1193 (1) (c) (i) of the Vehicle and Traffic Law of the State of New York.

On January 31, 2024, Ms. Transue appeared in Delaware County Court and pled guilty to Driving While Intoxicated – Prior Conviction in Ten Years, a Class E Felony.  Delaware County Court Judge John L. Hubbard sentenced Ms. Transue to five years of felony probation supervision and to the Adult Treatment Court program. He further revoked Ms. Transue’s license for one year and ordered the installation of an Ignition Interlock Device for one year.

Judge Hubbard further ordered that if Ms. Transue fails the Adult Treatment Court program, she will be sentenced to one and one third to four years in state prison.

Delaware County District Attorney Shawn Smith thanked Officers Keith Gavette and Ernest Cawley of the Colchester Police Department for their work in getting Ms. Transue off the road.

“I want to thank the Officers in this case for their fine work in getting Ms. Transue off the road that night. Sadly, like many others in our community, Ms. Transue suffers from a severe alcohol problem.  It is my belief that with the intervention of Officers Gavette and Cawley, she is on the right path towards achieving long term sobriety.”

Mr. Smith continued, “I also want to thank the Las Vegas Court system for retrieving Ms. Transue’s Nevada records for us. Drunk driving is not limited to Delaware County, and this case is proof that drunk driving prosecution is not geographically limited. If you drive drunk, you will be pulled over, and rest assured my office will diligently scour records to see if you’ve done it before.”

First Assistant District Attorney Schuyler Konior Kinneman prosecuted the case.

JAIL SENTENCE IN ENDANGERING THE WELFARE OF A CHILD CASE

DELHI – William Polhamus, 35, of Harpursville, New York, appeared in Delaware County Court on February 5, 2024, for sentencing on one count of Endangering the Welfare of a Child in violation of Section 260.10 (1) of the Penal Law of the State of New York.

On July 4, 2023, Officer Kathryn Mitchell of the Walton Police Department was dispatched to a physical domestic in progress in the Village of Walton. According to the report, Mr. Polhamus had physically assaulted a woman in front of a minor child. A third party called while Officer Mitchell was en route and reported that Mr. Polhamus had taken another minor child and had driven off on a motorcycle. When Officer Mitchell spotted Mr. Polhamus and activated her squad car’s lights, Mr. Polhamus accelerated the motorcycle and began to weave in and out of traffic. Officer Mitchell estimated the speed on the motor bike to be over 70 miles per hour.

In order to prevent an escalation of the chase, officers called off the pursuit and began to investigate where Mr. Polhamus was going. As officers were interviewing the mother of one of the minor children, Mr. Polhamus sent text messages to the mother, threatening to kill himself. Officers immediately phoned dispatch for a wellness check at Mr. Polhamus’s residence. New York State Police Trooper Mazzarella and Trooper Seber were able to make contact and placed Mr. Polhamus under arrest.

Polhamus appeared before the Honorable John L. Hubbard, Delaware County Court Judge, for sentencing on February 5, 2024. Per a negotiated plea agreement, the Court sentenced Mr. Polhamus to 1 year in jail. The Court also ordered that Mr. Polhamus pay the crime victim’s fee and assessed the mandatory state surcharge.

District Attorney Shawn Smith commended Village of Walton Police Officer Kathryn Mitchell for her thorough investigation into this case, which enabled us to secure a conviction without a trial. “Domestic violence can have a serious effect on young children, and our office will continue to work with law enforcement to make sure that domestic offenders are held accountable for their actions.”

Cannon Free Library Features West African Drummer Zorkie Nelson

By Mary A. Crisafulli

DELHI - The Cannon Free Library celebrated the start of Black History Month by hosting a performance by West African Drummer Zorkie Nelson on Feb. 3.

The event was an interactive percussion performance. Having studied music since age seven, Nelson has many talents including being a master percussionist, flute player, and vocalist specializing in the Ga cultural tradition. Nelson is from the West African city of Accra in the Republic of Ghana.

Lynn Dennis, library youth services director, is responsible for organizing the event.

Dennis secured a grant from W.I.D.E. (Women for Inclusion, Diversity, and Equality). W.I.D.E. offers book grants to teachers and librarians to purchase stories about or written by historically marginalized populations. W.I.D.E. Co-founder Jenine Osbon said Dennis chose the books she hoped to offer for free, which aligned with W.I.D.E. guidelines. "For this event, to celebrate Black History Month, the books focused on the different stories of various black figures, fiction, and nonfiction, and their struggle to overcome inequality and triumph in the face of adversity," said Osbon. Books offered to families included "Moses: When Harriet Tubman Led Her People to Freedom" by Carol Boston Weatherford and Kadir Nelson, "Little Melba and Her Big Trombone" by Katheryn Russell-Brown, "New Kid" by Jerry Craft, and "Nana Akua Goes To School" by Tricia Elam Walker. Twenty books were donated to the library.
