HHS Open Each Saturday Through Labor Day

HARPERSFIELD  - The Harpersfield Historical Society is open each Saturday from 11 a.m. until 2 p.m. until Labor Day or by appointment. For an appointment call 607-437-7765.

The HHS is also in need of volunteers with various skill. Please contact the HHS if you can volunteer your time to preserve the area's history. The museum is located next the Harpersfeild Town Hall, behind the Post Office off State Route 23.

Michigan Man Facing Charges in Kortright

KORTRIGHT — Sheriff Craig S. DuMond announced that a Homer, Michigan man is facing the charges of Criminal Contempt in the First Degree and Harassment in the Second Degree, following an Order of Protection Violation, which occurred in the Town of Kortright. 

On May 25th, 2024, Deputies responded to a reported domestic dispute in the Town of Kortright. Upon the completion of the investigation, Deputies arrested charged 25-year-old Justin Robinson with one count of Criminal Trespass and one count of Harassment. Robinson was arraigned through the Delaware County Centralized Arraignment Court, where an order of protection was issued on behalf of the victim of the domestic dispute.

On June 3rd, 2024, Delaware County Sheriff's Deputies were advised that Justin Robinson had returned to the residence of the victim. Upon arrival at the residence, Deputies located Justin within the residence of the protected party of the order of protection. It was reported by the victim that she had been harassed by Robinson, after he had violated the order of protection by returning to her residence. 

Upon the conclusion of their investigation, Deputies subsequently arrested and charged Robinson with one count of Criminal Contempt in the First Degree a class E Felony and one count of Harassment in the Second Degree a Violation. Robinson was held at the Delaware County Correctional Facility to await centralized arraignment.

Kassi Valazza at WKC on June 21

EAST MEREDITH — Kassi Valazza, an up and coming country and American songwriter will give a concert you don’t want to miss at the West Kortright Center on June 21 at 7pm. 

There is a cult-like fascination growing around Kassi Valazza following the self-release of her 2019 debut album Dear Dead Days and her surprise 2022 EP Highway Sounds. She is seated squarely at the vanguard of new American songwriters strengthening and broadening the sound of country music as she tours with celebrated acts such as Melissa Carper and Riddy Arman. The Southwestern native resides in Portland, a hotbed of songwriters producing albums that both bear the torch and bend the arc of American roots music, where she recently signed with Fluff & Gravy Records — a label known for launching Anna Tivel and Margo Cilker.

CONVICTION IN CHILD SEXUAL ABUSE CASE


DELHI — Delaware County District Attorney Shawn J. Smith announced that John Macrabie, 27, of Otego, New York pleaded guilty to Sexual Misconduct, a Class A Misdemeanor on June 3, 2024. 

The defendant appeared in Delaware County Court on June 3, 2024, for the continuation of a Huntley hearing.  However, instead of proceeding with the hearing, the defendant pleaded guilty to Sexual Misconduct- Oral Sexual Conduct, a Class A Misdemeanor.  The defendant is alleged to have engaged in oral sexual conduct with a 15-year-old child in the Town of Walton on September 4, 2021. 

This guilty plea was entered pursuant to a negotiated disposition wherein it is expected that the defendant will be required to register as a sex offender for at least 20 years, and he will also be placed on sex offender probation for 6 years.  

The case is scheduled for sentencing on July 22, 2024, at 10:00 A.M. 

District Attorney Smith commended Delaware County Sheriff’s Deputy Justin Mohr and the Criminal Investigation Division of the Delaware County Sheriff’s Office for their thorough investigation into this case. Smith also thanked the victim’s advocates at Safe Against Violence for the support they provided to the victim in this case.  

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.

Delhi Resident Arrested on Warrant

Delhi – Today, Sheriff Craig DuMond announced the arrest of a Delhi, New York resident after a warrant was issued for his arrest by the Town of Walton Court, and the Town of Deposit Court.  

On Wednesday May 7th, 2024, Sheriff’s Deputies responded to a domestic that was no longer in progress in the Town of Walton. During the course of their investigation, Sheriff’s Deputies found that on May 1st, 2024, while in the Town of Walton Michael Kirby, age 62 had violated an order of protection that was in place by the Town of Delhi Court. Further investigation by Sheriff’s Deputies found that Kirby had recklessly engaged in conduct which created a substantial risk of serious physical injury to another person. It was further found that on May 3rd, 2024, while in the Town of Deposit Michael Kirby had violated the order of protection that was in place by the Town of Delhi Court and that Kirby had sent text messages to the victim threatening to cause physical harm. At the end of their investigation Sheriff’s Deputies sent a warrant request to the Town of Walton Court and to the Town of Deposit Court.  

On Wednesday May 22nd, 2024, Sheriff’s Deputies responded to a domestic no longer in progress in the Town of Delhi. During the course of their investigation Sheriff’s Deputies found that Michael Kirby had violated the order of protection out of the Town of Delhi Court by means that Kirby had subjected the victim to physical contact.

On Wednesday, May 29th, 2024, Sheriff’s Deputies located and arrested Michael Kirby on an arrest warrant out of the Town of Walton for Criminal Contempt 1st a Class E Felony, and Reckless endangerment 2nd a Class A misdemeanor. Sheriff’s Deputies also arrested Kirby on the arrest warrant out of the Town of Deposit Courts for Criminal Contempt 1st a Class E Felony, and Aggravated Harassment 2nd a Class A misdemeanor.  Kirby was charged with a third count of Criminal Contempt, 1st a Class E Felony and Harassment 2nd a Violation from the incident from May 29th, 2024. 

Kirby was transported to Delaware County Centralized Arraignment Court where he was remanded to the Delaware County Correctional Facility in lieu of $10,000 cash bail or $50,000 secured bond.

Delhi Man Arrested on Assault Complaint

DELHI – On Thursday afternoon, May 23rd, 2024, Delaware County Sheriff's Deputies arrested a Delhi man on charges stemming from an Assault Complaint that occurred in the Town of Delhi. 

On May 23rd, 2024, at approximately 2:45 PM, Delaware County Sheriff’s Deputies responded to an Assault Complaint in the Town of Delhi.  

Further investigation of the incident revealed that 30-year-old Michael P. Stein of Delhi NY, had struck another individual in the head with a baseball bat after a verbal altercation.

Deputies subsequently arrested and charged Michael Stein JR with one count of Assault in the Second Degree, a class D Felony, Criminal Mischief in the Fourth Degree, Menacing in the Second Degree, Criminal Possession of a Weapon in the Fourth Degree and Obstructing Governmental Administration in the Second Degree, all Class A Misdemeanors in the New York State Penal Law.

Stein was transported to Delaware County Centralized Arraignment where he was held and later remanded to the Delaware County Correctional Facility in lieu of $25,000 cash, $50,000 secured bond.

Oneonta Resident Arrested on Warrant

Delhi – Today, Sheriff Craig S. DuMond announced that a Oneonta, NY resident has been arrested on an Arrest Warrant for Criminal Possession of a Controlled Substance, Tampering with Physical Evidence, Aggravated Unlicensed Operator in the Third Degree, Operation of a Motor Vehicle while Registration is suspended, Operating an Unregistered Motor Vehicle, Operating a Motor Vehicle while license was suspended, and an Obstructed License Plate on charges stemming from a traffic stop investigation that occurred on April 1st, 2024.

In the early morning of, May 29th, 2024, Sheriff’s Deputies received notification from members of the New York State Police that they had 29-year-old Mercedes J. Torres in custody for charges following a traffic stop and for an Arrest Warrant stemming from a traffic stop investigation within Delaware County in the Town of Davenport.  Torres was subsequently arrested and processed by NYSP prior to being turned over to Delaware County Sheriff’s Office Deputies for the Arrest Warrant.  

Delaware County Sheriff’s Office Deputies subsequently met with the NYSP Troopers and took custody of Torres.  Torres was booked into the Delaware County Jail for the Arrest Warrant for Criminal Possession of a Controlled Substance, Tampering with Physical Evidence, Aggravated Unlicensed Operator in the Third Degree, Operation of a Motor Vehicle while Registration is suspended, Operating an Unregistered Motor Vehicle, Operating a Motor Vehicle while license was suspended, and an Obstructed License Plate and is awaiting arraignment in the Central Arraignment Process.

Glueckert Elected as Area Representative

Delaware County is proud to announce the election of Delaware County Probation Director, Scott  Glueckert, to the position of Area Representative for the State of New York to serve the American  Probation and Parole Association (APPA). In this newly elected role Director Glueckert will  represent the interests of New York Probation Officers and Parole Officers and contribute to the  development of policy and probation practices nationally. The APPA serves as the field’s leading  professional membership association. Their work is supported by thousands of dedicated  members throughout the United States, Canada and other countries actively involved in  strengthening community corrections work.  

Director Glueckert is currently an active member of the New York State Council of Probation  Administrators where he has previously held the titles of Treasurer, Vice-President and President  within the organization. Director Glueckert will be serving a two-year term as Area  Representative and is looking forward to collaborating with probation professionals across the  country to enhance community supervision. 

The Delaware County Board of Supervisors congratulates Director Glueckert in receiving this  honor and we are extremely proud of his accomplishments. He has served Delaware County with  the same professionalism, fairness and respect that earned him this position and we know he will  do great things in his capacity as Area Representative.

PRISON SENTENCE IN BAIL JUMPING CASE

DELHI- On June 3, Delaware County District Attorney Shawn J. Smith announced that Aidan M. Demorier, 20, of Johnson City, New York, was sentenced to a period of incarceration lasting between one and one third to four years for the crime of Bail Jumping in the Second Degree, a Class E Felony.

On April 1, 2022, Demorier failed to appear in court after being released on his own recognizance while facing felony charges. He also failed to turn himself in thirty days after missing his court date.

On March 21, 2024, the Delaware County Grand Jury indicted Demorier for the crime of Bail Jumping in the Second Degree. An arrest warrant was issued, and he was taken into custody shortly after. On April 8, 2024, the defendant pled guilty to Bail Jumping in the Second Degree. 

On June 3, 2024, the defendant appeared before the Honorable Judge Gary Rosa for sentencing. Pursuant to the negotiated plea between the defense and the District Attorney’s Office, Judge Rosa imposed sentence of an indeterminate period of incarceration lasting between one and one third to four years in State Prison. 

First Assistant District Attorney Schuyler Konior Kinneman prosecuted the case.

DA Shawn Smith commented, “Mr. Demorier’s case follows an all too familiar pattern here in New York State as a result of bail reform.  A frequent offender gets released on serious charges and then never returns to court to face justice. Thankfully, Bail Reform has not taken away all our tools to hold such individuals accountable. Although it creates additional work for law enforcement and our office, we will vigorously prosecute defendants that fail to return to court.”

Delhi Man Arrested After Harassment Complaint

Delhi  – Today, Sheriff Craig S. DuMond announced that harassment complaint in the Town of Delhi have resulted in the arrest of 64-year-old Lamsen, Richard of Delhi, New York.

On Saturday April 27th, 2024, Deputies were dispatched to a harassment complaint that had occurred at Curtis Lumber on State Highway 10 in the Town of Delhi. It is alleged that 64-year-old Lamsen, Richard, of Delhi, had engaged in a physical altercation with the victim. It is alleged that Lamsen had struck the victim with an open hand and then impeded the normal breathing of the victim. The victim’s complaint was forwarded to the Town of Delhi Court, for a criminal summons. 

On Monday afternoon, May 13th, 2024, Deputies received a criminal summons from the Town of Delhi Court to be issued to Lamsen for the charge of Harassment and Criminal obstruction of breathing. 

Lamsen was arrested on the criminal summons and released to appear before the Town of Delhi Court on a later date to answer the charges.

RECURRENT Show Beginning at ArtUp

MARGARETVILLE — ArtUp Gallery in Margaretville (746 Main Street, Binnekill Square) will open a new show RECURRENT with artists Denise Corley, Tom Fitzgibbon, and GG Stankiewicz this Friday June 7.  The show will run till June 30th.  Opening reception will be Friday the 7th from 4pm to 7pm.  Gallery hours are Friday thru Sunday 12pm till 4pm.

Corley, Fitzgibbon, and Stankiewicz expand on the notion of recurrent and recurrence.  Corley draws inspiration for her paintings and sculptures from her scuba diving experiences and underwater sea life.  Fitzgibbon works more directly with electrical currents creating mesmerizing LED assemblages.  Stankiewicz explores the charge of memory imbued in physical objects and environments.

Safety Track Site Plan Denied

Harpersfield Planning Board makes the final determination on the New York Safety Track site plan application.

HARPERSFIELD - After roughly two years of review the New York Safety Track site plan application was denied by the Harpersfield Planning Board.

The applicant, David and Gregory Lubinitsky, requested expansion of land use activities at the two-mile-long track on Zimmerman Road. Since the application was submitted in 2022, several amendments were made to the original request. The final proposed expansion of use included increased hours of operation, development of a .7-mile-long mini-track, and the ability to drive cars, not just motorcycles as currently permitted. 

Ultimately, the board found the plan did not adhere to town site plan review standards. The twenty-page resolution denying the site plan includes lengthy board findings regarding town standards and the application history.

The most notable finding is that the increased operation would cause raised noise levels in surrounding areas. This was concluded through use of a sound expert, who found the mini-track, if operated in conjunction with the original track during permitted hours, would not cause increased concern. However, the board found evidence that the track is operating beyond its permitted use. They also noted events planned as "races" which are not permitted. The board concluded it would be arbitrary to deny this information and determined the application would cause increased noise. They further determined the application could not be granted in absence of a comprehensive noise study. Due to these factors, the board also noted it does not have the staff or ability to monitor the track activities and enforce code violations.

The board found the roadways could not support the proposed expansion as well as it being detrimental to the natural characteristics of the area, among several other findings. The board found they were unable to determine some details based on the current information provided in the application including adjacent properties protection against noise, glare, unsightliness, or nuisances. The board was unable to conduct a site visit after they were asked by track owners to sign a contract and provide medical history as well as a social security number to do so. Phillips advised them not to sign and instead requested an alternative contract with the owners which was never agreed upon. Some additional information or application clarification was never received.

Attorney Allyson Phillips of Young/Sommer, hired by the town, said the applicant has the right to challenge the determination. A challenge would be sent to Delaware County for review if received.
